These Terms & Conditions (“Terms”) govern your use of the Drainfield Defender website and related services, including scheduling, communications, documentation, invoicing, and non-plan services.
Scheduling and Access
You agree to provide accurate information and safe, reasonable access to the property and relevant components. We may reschedule due to weather, unsafe conditions, lack of access, or events beyond our control.
If we arrive and cannot perform scheduled services due to access issues or unsafe/inaccessible conditions, a trip/lockout fee may apply (as communicated at scheduling or on your invoice/estimate).
Customer Responsibilities
You agree to:

Secure pets and remove hazards

Provide access instructions (gate codes, lock instructions, parking guidance)

Provide any reasonably necessary items disclosed in your agreement/service instructions (for example, access to components required to perform service)
Estimates; Authorization for Additional Work
Services outside a signed Maintenance Agreement (or outside a quoted scope for one-time services) require your approval (signed estimate, email/text approval, or other written authorization). Once approved, you authorize us to perform the work and invoice accordingly.
Field Service Software, CRM, and Communications Tools
We may use Housecall Pro to manage scheduling, customer records, service documentation, and communications related to Services. We may use Copper CRM to manage inquiries, customer contacts, service requests, and related communications. We may use phone/SMS providers (including Dialpad where applicable) to contact you regarding scheduling, updates, and invoices.
Subcontractors / Independent Contractors
To provide Services efficiently, we may engage independent contractors or subcontractors for certain work (for example, soil evaluation, design/engineering, lab testing, installation/excavation, or specialty services).
Unless otherwise stated in writing:

Subcontractors are independent businesses and not our employees

We may coordinate scheduling and share the minimum necessary information to perform the work

Subcontracted work may be subject to the subcontractor’s licensing, insurance, and warranty practices
Pumping / Hauling
If pumping is recommended, we may provide a referral or coordinate communication. Unless otherwise stated in writing, the pumping contractor is a separate business and the customer may contract/pay the pumper directly.
Communications
You authorize service-related communications via phone, email, and text (including through Housecall Pro and Dialpad where applicable). Message/data rates may apply.
Photos/Video During Service
We may capture photos/video during service for documentation, training, safety, and quality control. Public/educational use will be handled consistent with any consent you provide and applicable agreements.
No Guarantee
We do not guarantee system performance, regulatory outcomes, or that a system will not fail.
Payment; Nonpayment
Payment terms are stated on invoices/estimates or in the signed Maintenance Agreement. Past-due amounts may result in suspension of scheduling/services and/or other lawful remedies.
Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim is limited to the amount paid for the specific service giving rise to the claim.
Governing Law
These Terms are governed by Delaware law.
Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date reflects the latest version. Continued use of the Services after changes means you accept the updated Terms.
